Rental Agreement

• All rental costs are charged in 24-hour increments, with the first day being a set rate, and any additional days at a discounted rate.
• Student, faculty, and staff members must be physically present and show I.D. to receive discount pricing. Only one item per category may be rented at student price, per person. Discount pricing may not be applied to rentals for person who are not a student, faculty, or staff.
• Inspect equipment for broken or missing pieces, and check the weather conditions before renting. NO REFUNDS will be assessed after check-out process is complete.
• Rental equipment that is returned broken or missing pieces will incur a fee. You assume all liability and responsibility for any damage to rental equipment, including any damage caused by others. Rental equipment returned dirty will incur an additional fee for cleaning.
• Upon check-in, staff may require customer assistance with transport and set up of equipment. Customers must be present until the check-in process is complete.
• Failure to return rental equipment by the agreed due date and time will result in a late fee charged at the rate of an initial day's rent. In the event of lost or stolen rental equipment, or rental equipment damaged beyond repair, renter will be solely responsible for the full cost of replacement.

Rental Liability Waiver

By signing this agreement and waiver, you attest and agree to the following:

I acknowledge that I have the necessary skills to operate the rented equipment properly. I also acknowledge that I will use the equipment in a safe manner that is not contrary to recommended use or manufacturer's standards. I am aware of hazards associated with the use of outdoor equipment, including, but not limited to, physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity.

I expressly agree and promise to accept and assume all of the risks relating to the rental activities. My participation is purely voluntary and I elect to participate in spite of the risks.

I agree to indemnify, defend, save, and hold harmless Utah Tech University, its departments, agencies, boards, commissions, and its officials, agents, and employees for, from and against any and all claims, actions, liabilities, damages, losses, or expenses (including court costs, attorneys' fees, and costs of claim process, investigation, and litigation) for bodily injury or personal injury (including death), or loss or damage to tangible or intangible property, caused by my use or my permission to use the rental equipment, express or implied, and my breach of this agreement or failure to comply with any applicable law related to use of the rental equipment.

I understand that loading equipment onto or in my vehicle has the potential to cause damage to person or property during the loading, unloading, or transport of the equipment. By signing this agreement and waiver, I attest that my vehicle is suitable for loading, unloading, and transporting rental equipment, and that I have any other necessary tools or equipment required for loading, unloading, and transporting. Loading, unloading, and transporting rental equipment constitutes use of the rental equipment. As provided above, I assume all responsibility for properly loading, unloading, and transporting the rental equipment, and release Utah Tech University from all liability and harm to person or property from this use.

Any disputes under this agreement, or resulting from my use of the rental equipment, shall be governed by the laws of the State of Utah, with venue in Washington County.
